1. INTRODUCTION

This privacy policy (this "Privacy Policy") covers and describes how Fastly, Inc. and its subsidiaries ("Fastly", "We" or "Us") collect, use, and disclose the personal information we collect through https://www.fastly.com/, , https://docs.fastly.com/, https://status.fastly.com/, https://community.fastly.com/ and the login and billing pages of our services available from https://app.fastly.com (our "Websites"). The personal information of our subscribers' personnel collected through our Websites or of individuals that register to attend our marketing events or receive our marketing materials (“Marketing Activities”) is governed by this Privacy Policy other than Section 7.

Please read this policy carefully to understand how we collect, use, disclose, and protect your personal information (or, alternatively, "personal data") collected through our Websites and Marketing Activities, as well as the choices available to you regarding that information. Section 7 of this Privacy Policy separately covers and describes how Fastly collects, uses, and discloses the personal information submitted to us by our subscribers (or their internet clients) or that we collect through our content delivery and related services, including at app.fastly.com (our "Services"), the use of which by our subscribers is governed by our subscription agreements with our subscribers.

Fastly has certified its Services under the EU–U.S. Privacy Shield Framework set forth by the U.S. Department of Commerce and the European Union. Section 7 of this Privacy Policy applies to our Services and not to personal information collected through our Websites or Marketing Activities.

2. FASTLY COLLECTION AND USE OF PERSONAL INFORMATION

2.1. Why does Fastly collect my personal information?

Fastly uses personal information that you provide us so we can deliver content on our Websites, plan and host Marketing Activities and to provide services for which you have engaged us.

We use this information in the following ways:

  • To present our Websites and their contents to you.
  • To provide you with information or services that you request from us.
  • To provide you with notices about your account and/or subscription, including expiration and renewal notices.

2.2 What types of personal information does Fastly collect?

The types of personal information we collect and share depend on which of our Websites you use. In general, we may collect information that identifies you, information about how you use our Websites, and the information that you create while you interact with our Websites.

Information that we collect from you may include the following:

  • Information that can personally identify you, such as name, postal address, e-mail address, or telephone number, either actively or passively.
  • Information about your Internet connection, the equipment you use to access our Websites, and your use of our Websites.
  • Information that you provide when you fill in forms on our Websites.
  • Records and copies of your correspondence (including e-mail addresses, IRC handles, and Twitter handles), if you contact us.

  • Details of transactions you carry out through our Websites or related to orders of our Services such as credit card information.

You also may provide information as a contributing user that is published or displayed (hereafter, referred to as "posted") on public areas of our Websites, or transmitted to other users of our Websites or third parties. We may also collect and use information that identifies you in planning and hosting corporate events related to our Marketing Activities (e.g., user conferences).

2.3 How does Fastly collect my personal information?

Fastly collects your information both actively and passively as you interact with our Websites or contact us.

Fastly may directly collect personal information you provide us in the following ways:

  • When you complete forms on our Websites, such as registering an account, subscribing to a Service, or posting a comment.
  • When you create an account to use our Services or create a new user for that account.
  • When you complete transactions through our Websites, such as fulfilling an order for our Services.
  • When you perform search queries on our Websites.
  • When you post messages on our Websites, either in public areas or directly to other users or third parties.
  • When you use our publicly accessible blogs.
  • When you contact us outside of our Websites, such via email or Twitter.
  • When you request assistance from our Support team.
  • When you respond to surveys we ask you to complete for research purposes.
  • When you provide information that will be posted published or displayed (hereafter referred to as "posted") on public areas of our Websites.
  • When you transmit information to other users of our Websites or third parties as a user contribution.
  • When you register for or attend our Marketing Activities.

2.4 Does Fastly collect personal information automatically?

As you navigate through and interact with our Websites, we may use automatic data collection technologies to collect certain information about your equipment, Internet connection, browsing actions, and browsing patterns. We gather certain information automatically and store it in log files. This information may include Internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data.

The information we collect automatically is statistical data and does not include personal information, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties. This information helps us to improve our Websites and to deliver better and more personalized Service.

Fastly and our partners use cookies or similar technologies to analyze trends, administer our Websites, track users' movements around our Websites, and to gather demographic information about our user base as a whole. Users can control the use of cookies at the individual browser level.

We use cookies to help optimize your viewing experience while you use our Websites. You can control the use of cookies at the individual browser level. If you reject cookies, you may still use our Websites, but your ability to use some features or areas of our Websites may be limited.

We partner with a third party to manage our advertising on other sites. Our third party partner may use technologies such as cookies to gather information about your activities on our Websites and other sites in order to provide you advertising based upon your browsing activities and interests. 2.5 How does Fastly use my personal information?

We use your information to enhance your experience using our Websites and Services.

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Websites and their contents to you.
  • To provide you with information, products, or Services that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account and/or subscription, including expiration and renewal notices.

2.6 How long does Fastly retain my information?

We retain your information for as long as your account is active or as needed to provide you our Services. We also retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. When we delete any information, it is deleted from the active database, but may remain in our archives.

3. THIRD PARTY COLLECTION AND USE OF PERSONAL INFORMATION

3.1 Does Fastly share my personal information with others?

We may share your information with certain third parties. This sharing is based on our relationship with those parties, your consent, or legal or contractual obligations that require us to share such information.

We may disclose personal information that we collect or you provide as follows:

  • To our subsidiaries and affiliates for the purposes outlined in this Privacy Policy.
  • To contractors, service providers, and other third parties we use to support our business. These entities are bound by contractual obligations to keep personal information confidential and can use it only for the purposes for which we disclose it to them.
  • To third parties to market their products or services to you if you have consented to them. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Fastly's assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by Fastly about our Websites users is among the assets transferred. You will be notified via email and/or a prominent notice on our Websites of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
  • To display advertisements to our advertisers' target audiences. Although we don't disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.
  • When you create an account on our community forum. Your account is publicly accessible unless you change the privacy settings of your profile through your account portal.

We may also disclose your personal information:

  • To comply with any court order, law or legal process, including responding to any government or regulatory request, lawful requests by public authorities, or to meet national security or law enforcement requirements.
  • To enforce or apply our terms of service and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Fastly, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

3.2 Do third parties collect my personal information?

Some content or applications, including advertisements on our Websites, are served by third parties, including advertisers, ad networks and servers, content providers, and application providers who may collect your information as you interact with those parties through our Websites.

This collection can occur under the following circumstances:

  • When you log in to our Websites using sign-in services such as Facebook Connect or an Open ID provider.
  • When you use social media features, such as the Facebook Like button, and widgets, such as the Share button or interactive mini-programs that run on our site. These features may collect your IP address, which page you are visiting on our Websites, and may set a cookie to enable the feature to function properly. These social media features are either hosted by a third party or hosted directly on our Websites.

These third parties may also use automatic data collection technologies such as cookies or beacons to collect information about you when you use our Websites, your online activities, and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

3.3 User Data Supplementation

We may receive information about you from other sources, including publicly available databases or third parties from whom we have purchased data, and combine this data with information we already have about you. This helps us to update, expand and analyze our records, identify new customers, and provide products and services that may be of interest to you. If you provide us personal information about others, or if others give us your information, we will only use that information for the specific reason for which it was provided to us.

Examples of the types of personal information that may be obtained from public sources or purchased from third parties and combined with information we already have about you, may include:

  • Contact information about you from third party sources to verify your address so we can properly prevent fraud or communicate with you; or
  • Data purchased from third parties, such as social networking sites and conference attendee lists, that is combined with information we already have about you, to create more tailored advertising and products.

3.4 How is my personal information handled by third-party sites?

Our Websites may include links to other websites whose privacy practices may differ from those of Fastly. If you submit personal information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit.

3.5 What do I need to know about Single Sign-On services?

You can log in to our Websites using sign-in services such as Facebook Connect or an Open ID provider. These services authenticate your identity and provide you the option to share certain personal information with us such as your name and email address to pre-populate our sign up form. Services like Facebook Connect give you the option to post information about your activities on our Websites to your profile page to share with others within your network.

4. YOUR CHOICES AND RIGHTS

4.1 How can I limit how my information is used and disclosed?

You can use certain web browser and opt-out options to limit the personal information you provide us.

The following mechanisms are in place to provide control over your information by:

  • Turning off tracking technologies and advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being set. If you disable or refuse cookies, please note that some parts of our Websites may become inaccessible or not function properly.
  • Opting out. If you have subscribed to our newsletter(s), you can choose to stop receiving marketing emails, such as our newsletter or new product announcements, by following the unsubscribe instructions included in these emails.

4.2 How can I correct my personal information?

If you want to review, delete, or change your personal information, you can log in to the appropriate Website and visit your account profile page.

After you log in, you can send us an e-mail at the address noted in the Contact Information section below to request access to, correction of, or deletion of any personal information that you provided to us. You can also request closure of your account through the account closing mechanism within your account settings. We will respond to your request within 30 days.

Upon request, we will provide you with information about whether we hold, or process on behalf of a third party, any of your personal information. To request this information please contact us via the information supplied in the Contact Information section below.

4.3 How can I remove my information from Fastly

To remove your personal information from our blog, please follow the instructions to remove posts or delete your user account. If you want your personal information removed from other places on our Websites, please contact us via the information supplied in the Contact Information section below.

In some cases, we may not be able to remove your personal information, in which case we will let you know that we are unable to do so and why.

4.4 How can I report abuse?

4.5 How do I know when changes to this Privacy policy occur?

We post changes we make to this Privacy Policy on this page. We also provide a notice that this Privacy Policy has been updated on http://docs.fastly.com/changes.

If we make material changes to how we treat our users' personal information, we will notify you by e-mail to the primary e-mail address specified in your account and/or through a notice on http://docs.fastly.com/changes page thirty (30) days prior to the change becoming effective. The date this Privacy Policy was last revised is identified at the top of the page. 5. SECURITY AND PRIVACY MEASURES

5.1 How does Fastly protect my information and data?

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

Information you provide to us is stored on our secure servers behind firewalls. Any sensitive information is encrypted using Transport Layer Security (TLS) (sometimes referred to as Secure Sockets Layer or SSL).

You must also make sure that your information is safe and secure. Even if we give you (or you have chosen) a password for access to certain parts of our Websites, you are responsible for keeping this password confidential. Do not share your password with anyone. We urge you to be careful about giving out information in public areas of our Websites, for example, message boards. The information you share in public areas may be viewed by any user of our Websites.

Information that is transmitted via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Websites. Any transmission of personal information is at your own risk. We are not responsible if you circumvent any privacy settings or security measures on our Websites.

5.2 How does Fastly limit access to my personal information?

We limit access to certain pages on our Websites and allow you to set certain privacy settings via your account profile; however, be aware that no security measures are perfect or impenetrable.

Additionally, we cannot control the actions of other users of our Websites with whom you may choose to share your user contributions. Given that, we cannot and do not guarantee that your user contributions will not be viewed by unauthorized persons.

6. OTHER IMPORTANT INFORMATION

6.1 Children Under the Age of 13

Our Websites are not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Websites.

We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on our Websites or on or through any of their features, register on the Websites, make any purchases through the Websites, use any of the interactive or public comment features of our Websites or provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13, we will delete that information.

6.2 California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Websites that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. 7. Fastly Services.

Fastly subscribers electronically submit (or cause to be submitted) data to the Services for caching, transmission, and associated processing, and Fastly caches, transmits, and processes data only as provided in our subscription agreements with our subscribers, such as our Terms of Service available at https://www.fastly.com/terms. Additional information about our privacy and security practices with respect to our Services is available at https://docs.fastly.com.

As the subscribers (or in some cases their internet clients) control the data to be cached, transmitted, and/or processed, Fastly's network, platform, and services may be used as a conduit for information. As the Privacy Shield Framework does do not impose secondary liability, to the extent Fastly, on behalf of a subscriber, merely transmits, routes, switches, or caches data, Fastly may rely on its subscribers to comply with legal requirements underlying the Privacy Shield Framework or other frameworks with respect to such processing.

7.1 Information Related to Data Collected Through our Services

The use of personal information collected through our Services at the direction of our subscribers shall be limited to the purpose of providing the Services for which the subscriber has engaged Fastly. Although Fastly collects information related to subscriber personnel as they configure a subscriber's use of our Services, Fastly has no direct relationship with individuals whose personal information is collected, cached, or transmitted by the Services. subscribers are responsible for complying with any regulations or laws that require providing notice, disclosure, and/or obtaining consent prior to transferring the data to Fastly for processing purposes. Fastly also collects, uses and discloses personal information of individuals who visit our websites and applications ("Visitors") and individual representatives of our customers, suppliers, and business partners ("Business Contacts"). Personal information associated with Visitors and Business Contacts is collected, stored, and processed in accordance with Fastly's Privacy Policy outside of this Section 7.

7.2 Choice

Our Services collect information for our subscribers. As a data processor of this information on our subscriber's behalf, Fastly has limited ability to access information our subscribers submit to our services. If you are a data subject for whom a subscriber has submitted personal information to the Services and would like your information not to be disclosed to a third party or to be used for a purpose that is materially different from the purpose(s) for which the personal information was originally collected, then you should contact the subscriber directly. Concerns with personal information cached or transmitted by Fastly at the direction of our subscribers may be reported according to our acceptable use policy available at https://www.fastly.com/acceptable-use. We will refer your requests to the appropriate subscriber.

7.3 Accountability for Onward Transfer

Fastly is responsible for the processing of personal information it receives, and subsequently transfers to a third party acting as an agent on its behalf. Fastly may use from time to time third-party service providers, contractors and subprocessors to assist in providing the Services on our behalf. Fastly maintains contracts with these third parties restricting their access, use and disclosure of personal information in compliance with our Privacy Shield obligations, and Fastly may be liable if we fail to meet those obligations and we are responsible for the event giving rise to the damage.

7.4 Security

Fastly maintains administrative, physical, and technical safeguards to protect data submitted to the Services, including personal information. These security measures are set forth in our documentation available at https://docs.fastly.com/guides/security-measures/.

7.5 Data Integrity and Purpose Limitation

As a data processor, Fastly caches, transmits, discloses and processes data, which may include personal information about EU personnel received from its subscribers and their users, at the direction of its subscribers in accordance with our agreements. Fastly may process data to provide the Services, to prevent or address technical or service problems, to follow the instructions of our customer who submitted the personal information, or in response to contractual or legal requirements. Fastly does not control or own the data submitted by its subscribers, or their internet clients, to the Services. Fastly may share personal information with its subsidiaries, contractors, or third parties if Fastly undergoes a business transaction, such as a merger, acquisition by another company or sale of all or a portion of its assets.

7.6 Access to Data Controlled by our Subscribers

Fastly has no direct relationship with the individuals whose personal information our Services process on behalf of our subscribers. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate personal information should direct his or her query to the appropriate subscriber (i.e., the data controller). Subscribers have the ability to fulfill these requests, and Fastly will provide assistance for requests that subscribers are not able to complete. If the subscriber requests that Fastly remove the personal information, we will refer your request to the applicable subscriber and we will respond to its request within 45 days.

7.5 Data Retention

Fastly retains the personal information we process on behalf of our subscribers for as long as needed to provide Services to our subscribers. Fastly retains and uses this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

7.6 U.S. - Swiss Safe Harbor Framework

Fastly complies with the U.S. – Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from Switzerland. Fastly has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement.
